Constant calls

I have told them not to call me they keep on harassing me. It got to the point that I have a nervous breakdown! The worst part of it is, I lost a prospective Kobe because of them! They kept on calling me to the point I have anxiety and I lost job interviews! I have tried eve! Thanks to them I dont have a job now, they kept on occupying my phone line and sometimes I had foir calls at the same time! Im so fed up with them! Gonna call my lawyer!

Beware of working with Angelo Jarbo, a deliberate Lier, they work entirely on phone, misguiding, once they get you, they go after you even if the loan does not help you personally and they will tell any lie to cheat you on phone and make you sign the document. TILA violators and very cunning evil people.

Apparently this company thinks they can bully you into doing business with them. The fact that they think it's appropriate to call someone multiple times an hour, every hour shows me that I have no interest in giving them my business.

This company has called me 14 times I answered asked to be removed from they're list and asked that they don't call back. They called so many times I called they're offices to have someone act like it was no big deal and he'll just take me off the list now that they've called 14 time and made a day of being productive impossible because it's constantly different numbers so you can't block them. As someone that answers their phone while not at work to help anyone that might need help this is impossible.

Dear Sirs or Madam: FIRST AND FOREMOST, attached hereto are the documents with the names, telephone numbers, address, and loan numbers and parties this Complaint are filed against. I will NOT ALLOW Central Mortgage or any governmental agency to deflect this criminal, illegal and violation of rights complaint into a Modification fiasco or circus when the fact is the COMPLAINT filed against the two companies is ENTIRELY hinged on the criminal, illegal and intentionally malicious practices inflicted on me and the damages caused by both Central Mortgage Company and their agents, affiliates, associates or hired guns. The Complaint filed now with numerous agencies who seem to be falling into the trap of Central Mortgage's attempt to DIVERT the ATTENTION of the ROOT and BASE of the complaints which are COMPLETELY AND ENTIRELY related EXCLUSIVELY to the KNOWINGLY, INTENTIONAL AND VOLATILE violations of my civil right, consumer protected rights by their CLEAR and MORE THAN AMPLY EVIDENT criminal and illegal activities and procedures which caused more loss and damages to my property by CENTRAL MORTGAGE COMPANY by and through their hired guns and bullies SAFEGUARD ONLY and "DO NOT IN ANY WAY" have ANYTHING to do with the processing or any loan funding modifications with Central Mortgage or otherwise which is an issue that is being dealt with entirely on a separate level and process. HOWEVER, CENTRAL MORTGAGE is "ATTEMPTING" to DECEIVE and DEFLECT the ISSUES and their blatant disregard for us citizens and trample our rights with their vehemently IMPROPER actions and PROCEDURES which are the EXCLUSIVE BASIS FOR THIS COMPLAINT by "muddying the waters and throwing at the wall the Modification or financial and funding issue as would someone in a whistle blowing case as such. They are harassing me, violating my rights and when I fight for my rights and protection they avert the attention to the funding/loan processing which is "NOT" in any way shape or form a part of the complaint and they are merely EVADING the fact that they knowingly, intentionally and willingly by and through their orders and payment of hiring of Safeguard services illegally and criminally violated my rights as a citizen, consumer, property owner and damaged my home breaking in stealing personal property under the pretense of Loan Modification and property securing when they were CLEARLY, VERBALLY and NOTIFIED numerous times and ways that I, JESUS CASAL am taking care of my property and in charge of my property and DID NOT AUTHORIZE, REQUIRE, REQUEST or ALLOW PERMISSION for ANYONE to enter my property much less break into my home, trespass and enter my home, damage the door and caused more harm and damages to myself and my two large dogs (locked away in a small corner and left me unable to enter to walk, feed and water them as I usually did! THAT and ONLY that, the CRIMINAL AND ILLEGAL activities which include but ARE NOT LIMITED TO breaking and entering, use of forced entry to enter my residence, grand theft, Larceny, and burglary of an OCCUPIED building, trespassing, among many other CIVIL and CRIMINAL VIOLATIONS is the "ONLY" reason I filed a Complaint against my mortgage Finance Company and their bullying hired guns. NOTHING related to ANY OTHER issue should even be addressed nor should they be ALLOWED to muddy the waters and use "fruit of a poisoned tree" to enable them to Evade responsibility and accountability for their intentional and abusive practices as if we were in the "Billy the Kid" cowboy hay days! Central Mortgage Loan Modification Fraud

I am asking to contact me at cmclassactionsuit@***.com to help FIGHT this type of criminal behavior! Our trial period that was assigned to us in September 2009 is the MAIN reason that we are now facing foreclosure. We were instructed (Trial Period Agreement)by Central Mortgage to make the payments for 3 months. During this time period,CMC asked us NOT to pay the regular payments, because if we did it would possibly void the trial period, so we didn't and during this time CMC started to foreclose on our property and add on penalties to keep out of reach of making any type of payment to cure the default. This tactic alone is VERY questionable in how CMC does business. Because of the bad business practice we are now forced into bankruptcy. I just found your post---too late for me though. After 5 years of lies, subterfuge, lost documents etc etc we are finally losing the home.

First, they told us to STOP MAKING PAYMENTS to qualify for a loan mod. Them they lied , lost documents, etc for almost a year before turning us down for no reason given. Then they tried to foreclose and I WON IN COURT! That stopped them from being able to foreclose by auction.

Then we went through the process three more times with the same terrible lies and end results. Then they filed JUDICIAL foreclosure on us, but our state made them try the loan mod again. They APPROVED us! But wait..

I have a 2nd loan and a judgement. Central wanted me to make three 'trial' payments before giving me the mod. They told me twice that the 2nd loan and judgement were not a problem. We made the 3 payments of $1,333 and were then told the 2ns and judgement WERE a problem and had to come off, which wont happen.

So now we are screwed. Trial is in two months and the main thing I can give the court is the recording of the phone conversations. Ill probably be losing my families home of 21 years all over a simple request for a loan mod 5 years ago.

Everyine told me not to trust them and to save my money for moving. They were right.

I can tell you how CMC/Arvest works. They are untrained, uneducated, purposely misleading, intentionally misrepresenting, and totally anti-homeowner.

If you look at their websites it’s almost funny how CMC and Arvest claim to be willing and able to earn your trust and customer-focused.

If you have a Fannie or Freddie loan they will tell you they do modifications, but make it impossible for you to actually get the modification done. Lost paperwork, paperwork expired, can’t contact borrower, borrower doesn't make enough money….on and on it goes, and all the time they are either completely incompetent in the underwriting department and don’t know how to calculate income, or they are perfectly aware of what they are doing. Either way, the homeowner suffers. HAMP has guidelines! Its not random…it’s not guesswork… it’s not a CMC in house decision making product!!

If you DON'T have a Fannie or Freddie loan, they will say “we don’t do modifications”… OH REALLY? Let me tell you about CMC/Arvest. In most cases they are sub-servicers on a mortgage trust filed with the SEC. In the cases I have recently looked at, the Master Servicer is Wells Fargo. Wells Fargo is ultimately responsible for what the sub-servicers do, and the Master Servicer is in charge of modifications for any loans in the mortgage trust they service. CMC is a collection agency! If you want results..go directly to Wells Fargo and tell the what CMC/Arvest has been doing to you… Wells Fargo, if they are the master servicer on the trust your loan is in, IS by consent order, servicer participation agreement and the National Mortgage Settlement with the AG’s, OBLIGATED to follow the rules and guidelines for assisting homeowners. CMC/Arvest will tell you..”we will only do what is in the best interest of Wells Fargo”…. Let me be the first to tell you that with the agreements Wells Fargo has signed to ACT RIGHT, it IS in their best interest to NOT screw around with people’s homes!

Go to the SEC’s Edgar System… put the name of the Mortgage Trust in the search and take a look at the prospectus. It will tell you who is master servicer….go directly to them!! Oh, and since the SEC has approved the master servicer and sub-servicer on the Trust filing, I am wondering how ARVEST can respond to a modification request since CMC is listed, but Arvest isn’t. I don’t care that Arvest is the parent company, they aren’t approved by the SEC as far as I could find.

Oh, and one more thing….the National Mortgage Settlement releases Wells Fargo from liability on past actions as a Master Servicer, Servicer and Sub-Servicer. Now if they had no liability as a master servicer, why would they need relief as such??

I had an error that I could not correct in my post. FL is a full recourse state which means they can AND WILL go after the distressed owner for a FULL deficiency judgment.

It is much better in a recourse state to file for bankruptcy before they get a foreclosure and drag them for a long trip and pay nothing on that mortgage. Also this year is the last year that IRS will not enforce discharge of debt. So this is the year to get out of it but if you try a short sale or Deed in lieu then YOU BETTER GET IT IN WRITING THAT THE BANK WILL NOT GO AFTER YOU FOR A DEFICIENCY JUDGMENT.

Florida is a redneck Good ole boy court and they will take homeowners who default, or have a shot sale or foreclosure to task for every dime as if there was no housing bubble or real estate crash.

The reason for this is that Florida has no real business other than real estate scams. So the big land owners in FL wrote the laws to protect them, not the consumer.

To recap, if your state is a full recourse state, ie NOT a non-recourse state, then Central Mortgage Company will go for your throat and lead you to your doom. Remember when you file for a short sale you have to tell them all about your assets so they then know everything you have to attach from wages to other property to other financial interests.

We found a ready, willing, and able buyer last month and had submitted our short sale package to Central Mortgage. The buyer is very qualified but Central Mortgage won’t allow the short sale.

One of the owners who is attached to the title of our property is in bankruptcy but yet Central Mortgage continues to dis-regard our bankruptcy rights and is still looking for ways to move forward with the foreclosure. The customer representative with a name of David still continues to threat us of foreclosing our home. My wife and I are trying our best to cooperate with Central Mortgage to proceed with the short sale but they just won’t give us a chance. We contacted a government agency that handles complaints regarding banks which is called Consumer Financial Protection Bureau at (855) 411-CFPB (2372) to report CMC's unreasonable actions.

We believe this is the help that we are looking for. Wish us luck!
